Overview
This document outlines our commitment to respecting intellectual property rights and compliance with the Digital Millennium Copyright Act (DMCA). We take copyright infringement seriously and have implemented a progressive strike system to address violations.
Strike System
First Strike
Action: Strike recorded in our internal systems.
Notification: Creator receives notification explaining the violation, guidance on copyright compliance and counter notification notice.
Second Strike
Action: Strike recorded in our internal systems.
Additional Measures: Account added to enhanced monitoring system.
Notification: Creator receives 2nd warning notification explaining the violation, guidance on copyright compliance and counter notification notice.
Third Strike
Action: Final strike recorded in system.
Additional Measures: Account banned due to repeat infringement.
Notification: Creator receives letter advising of outcome, steps taken and their options.
Strike Expiration
Strikes automatically expire in accordance with KICK policy, if no additional copyright violations occur during that period. Once expired, strikes are removed from the creator's record for the purposes of determining progressive penalties.
DMCA Process
Notice Receipt: We review all DMCA takedown notices for completeness and validity
Content Review: Alleged infringing content is evaluated against the provided notice
Content Removal: Infringing content is removed from the platform
Action Implementation: If violation is confirmed, appropriate strike and remedial action is taken
Creator Notification: Account holder is informed of the violation and any imposed restrictions
Counter-Notification Process
Users who believe their content was removed in error may submit a counter-notification in accordance with DMCA procedures. We will review valid counter-notifications and may restore content if appropriate under applicable law.
